Welcome to James Boyd Photography. By accessing or using our website (jamesboydphotography.com) and related services, you agree to the following Terms & Conditions. Please read them carefully.

 

1. General Use of the Site

  • This site is owned and operated by James Boyd Photography.

  • You agree to use the site for lawful purposes only and in a way that does not infringe on the rights of others or restrict their use of the site.

  • Unauthorized use of this site may give rise to legal claims for damages and/or criminal liability.

 

2. Intellectual Property Rights

  • All photographs, images, graphics, text, and designs on this site are the exclusive property of James Boyd Photography, unless otherwise stated.

  • Purchasing a print or digital product does not transfer copyright.

  • You may not copy, reproduce, sell, license, distribute, or exploit any content without written consent.

 

Licensing Exceptions:

  • Personal Use License: Prints and digital downloads are for personal display only (home, office, personal gifts).

  • Commercial Use License: Commercial or editorial use requires a separate written license agreement. Contact us directly for details.

 

3. Products & Services

We provide:

  1. Prints & Fine Art Prints – available in standard and custom sizes, framed/unframed.

  2. Digital Downloads – high-resolution images for personal use.

  3. Workshops & Courses – in-person and/or online instruction in photography.

  4. Custom Orders – tailored photography services or print orders by request.

 

4. Orders, Payments & Billing

  • Payments are processed securely through Wix-integrated payment gateways (e.g., credit card, PayPal, Stripe).

  • All prices are listed in USD and may include applicable taxes.

  • Orders are confirmed once full payment is received.

  • We reserve the right to refuse or cancel orders due to errors in pricing, availability, or suspected misuse.

 

5. Shipping & Delivery

  • Print Orders: Prints are made to order. Production and shipping typically take 7–14 business days.

  • Custom Orders: Delivery times will be communicated upon confirmation.

  • We are not responsible for delays due to production by third parties, postal services, carriers, or customs.

  • Risk of loss passes to you upon delivery.

 

6. Digital Downloads

  • Files are delivered electronically via download link after payment.

  • Digital purchases are final and non-refundable.

  • You may not share, resell, or redistribute digital files in any form.

  • Editing, altering, or removing watermarks/copyright notices is prohibited.

7. Refunds, Returns & Cancellations

  • Prints: Refunds or replacements are offered for defective or damaged items reported within 7 days of delivery (with photo proof).

  • Digital Downloads: Non-refundable once the file is delivered.

  • Workshops:

    • Full refund available if canceled no later than 150 days before the event.

    • 50% refund available if canceled no later than 90 days before the event.

    • No refunds for cancellations made less than 90 days before the event, but you may transfer your spot to another participant or for a future workshop date.

  • Custom Orders: Deposit payments are non-refundable once production begins.

 

8. Limitation of Liability

  • We are not liable for indirect, incidental, or consequential damages arising from use of our site or products.

  • While we strive for accurate product descriptions and colors, actual product appearance may vary slightly due to monitor display settings and printing processes.

 

9. Workshops & Learning Experiences

  • Participants are responsible for their own safety during workshops, including in outdoor/nature settings.

  • We are not responsible for injury, loss, or damage to persons and personal equipment.

  • Workshop materials and lessons are copyrighted and may not be recorded, shared, or redistributed.

 

10. Third-Party Services

  • Our site may link to third-party services (e.g., payment processors, social media). We are not responsible for their content or policies.

13. Governing Law

  • These Terms are governed by the laws of the state of Indiana, USA, without regard to conflict of law rules.
